Attorneys for Donald Trump and partner Steve Carl filed suits in two state courts -- Supreme Court in Garden City and the Court of Claims in Albany. They filed the suits against the state Department of State and the Office of Parks, Recreation and Historic Preservation.
The Supreme Court action seeks a variance from the state building code prohibiting basements in a floodplain following two denials by a Department of State review board. It also asks the court to prohibit the parks department from declaring the developers in default for failing to meet a construction deadline by the end of next year.

After reviewing the suit, Justice Leonard Austin issued an order that, in effect, stopped the clock on the park department lease deadline and prevents the agency from declaring the developers in default of thr lease. It also orders the state agencies to preserve all emails on the project, pending a hearing April 15 before Austin.
The court of claims action seeks $500 million in damages from the parks agency for delays in construction caused by the requirement to get the Department of State variance and two approvals from the Department of Environmental Conservation.
