Kapsis' frivolous lawsuit days are over based on a decision by Judge Branveen.

Now who really has the Wilson-Pakoola power?

Mr. Kapsis has finally run into a Judge with the courage to "call it like it is - and do something about it" !!!

In a stunning decision the Supreme Court ordered James Kapsis - the self-declared [but "Bogus" according to the court] chairman of the Nassau County Independence Party to pay the legitimate leaders of the Party [the Peragine factions] $26,000.00 for his frivolous litigation against them ($23,750 plus costs and disbursements).

The court characterized the Kapsis law suits as "malicious" and "contumacious" and threw his case out of court.

After bringing a defamation suit against the Peragine group and the Independence Party State Chairman Frank MacKay - Kapsis spent three years trying to milk every bit of propaganda value out of his frivolous litigation. Eventually - Supreme Court Justice "Antonio Brandveen" had enough !!

In a scholarly opinion the Judge - step by step - detailed Mr Kapsis's charade, and threw his suit out of court.

The Judge then did what few Judges have the courage to do - he made Mr. Kapsis Pay for the trouble and expense that he caused the innocent people he sued.

The Judge used such words as "to harass"...and..."maliciously injure another" in describing Mr Kapsis's litigation.

To believe that this Judge did not thoroughly analyze Mr Kapsis's behavior and think this decision through - begs a must read of his Decision.

This was a dead issue 2 years ago. The only question that remains is will Peragine step up and endorse Peterson - that's the only move that will breath life into an otherwise dead party. Most of it's defectors left during the Kapsis-Peragine duals and joined the Gop team. If Peragine wants them back - he'll have to do the right thing and back Peterson.

someone better get the right amount of signatures for someone or nobody is getting on the ballot as an I. Kapsis has two 80 year olds and a couple of 70 year olds runing the show. Betweeen them they cant get 40 signatures. Peragine-who knows/

At the last Independence Party Convention Kapsis and his cronies got aprox. 275 weighted votes --- the Paragines got aprox. 40,000 weighted votes....

My money is on the Peragenes

Somehow - it appears that Newsday got the story. Newsday seems to have gotten it right - quite a feat for Newsday - but I wish they went much further - so we could discover what the real skinny is on this issue

Eliot Bloom's comment in the Newsday article - that the judgement that he and Kapsis now have to pay Peregines doesn't count because Kapsis wasn't present during the hearing on his sanctions - is the equilelant of Bloom and Kapsis sating - mome of this frivelous litigation counts because when we swore th complaint - we had our fingers crossed - Give...me...a...Break !!!!
