An unusual drop in admissions at many Long Island hospitals earlier this year, apparently sparked in part by fewer flu cases and postponement of elective procedures because of the economy, has forced two medical centers to take steps to cut costs.

Brookhaven Memorial Hospital Medical Center in East Patchogue is closing a 30-bed unit and reassigning 44 employees because of a dip in inpatient admissions since the beginning of the year, said Chris Banks, the hospital's vice president of development and external relations.

Banks said Brookhaven's admissions were down at about the same rate as those Islandwide: 2.71 percent for the first quarter compared with last year, according to the Nassau-Suffolk Hospital Council.

He said the closing was necessary because "we operate on a razor-thin margin like all hospitals in New York State."

The New York State Nurses Association applauds the Assembly’s passage of legislation to increase the penalty for assaulting a nurse (A3103/S4018). This legislation makes it a felony to physically attack a registered nurse, and licensed practical nurse in New York State.

For many nurses, violence is regularly viewed as “just part of the job.” In constant contact with the public, nurses must often practice in dangerous settings. Factors such as unrestricted access by the general public to healthcare facilities, the presence of gang members and drug and alcohol abusers in the emergency department, and distraught family members all contribute to increased violence in the workplace.

“On behalf of New York’s nurses, I thank the Senate and Assembly for caring about the registered nurses who care for them. This legislation signals to the public that violence against nurses will no longer be tolerated,” said Tina Gerardi, MS, RN, CAE, Nurses Association CEO.

Surgeons cannot reattach the arm of a Long Island man whose limb was severed when he set off amakeshift fireworks launcher during a weekend holiday celebration, a source said today.

WASHINGTON - Sen. Kirsten Gillibrand (D-N.Y.) Wednesday will introduce a bill to crack down on Medicaid and Medicare fraud, a problem that each year costs New York State $5 billion, including about $755 million on Long Island, an aide said Monday.

The proposed bill would double criminal penalties for fraud, toughen fraud prevention and set up a five-year pilot program to verify Medicare and Medicaid reimbursement claims.

"By creating more transparency and more accountability in Medicare and Medicaid, we can save taxpayer money and protect services for seniors and people who need them," Gillibrand said in a statement.

That doesn't mean they are not being looked at.

Prior posts about unsafe conditions and report methods have resulted in US Occupational Health and Safety Administration ordering Brookhaven Memorial to post a notice of investigation throughout the hospital.

See Human Resources Bulletin Board on 1st floor across from pharmacy and elsewhere.

Dated July 20, 2010 it specifies problems in Medical Affairs Wing (ammonia fumes in air ducts) and 2nd floor North/South (air ducts). The two page letter further indicates an investigation will be conducted.

Congratulations .....This is the beginning of a process that will continue to require your support and efforts. Keep it up. Let your federal reps know the conditions you have to suffer under. Thats Rep.Bishop, Sen Chuck Schumer and Sen Christin Gillibran.

Yes, OSHA is looking into it, but the letter only states that a complaint was made and that results of an air quality test need to be shown to OSHA by 7/27. Employees have already been told that the 'air is safe', regardless of their better judgment,and without any proof. Employees have been told that despite the odors causing illness, they must work in this environment, and if they don't like it they can find another job. OSHA will get their results from BMH (and the validity of these 'tests' are questionable at best) and that will be the end of it. Once again, the crooked ones will win.

Two of my doctors no longer will send me to Brookhaven. After waiting for something like 8 hours in the Emergency Room without being seen, I agree with my doctors. I have heard so many negative things about this place. Why is this allowed to go on? Patients hate it, the doctors hate it, and it sounds like the employees are doing just as bad as the patients. If it really is that bad someone should be able to do something. I can only speak of the horrible Emergency Department visit I had, and what my doctors tell me, but this sounds like a crazy movie to me.

BMH refuses to produce financial statements to Union (big surprise).

Union says "listen--you refuse to work with us, so we are unable to help you". Request denied.

Who suffers in the end? Crooks get what they want. Union files a grievance. Workers get nothing. So the contract means nothing. Crooks knew exactly what they were doing before they even entered into any 'talks' with the Union.

... Residents of a North Bellport neighborhood said they were rattled - but not surprised - by late-night shootings Wednesday that hospitalized three men.

Suffolk County Police are investigating the violence that erupted in a residential area between Patchogue and Brookhaven avenues, a police spokeswoman said.

One man, 26, received multiple gunshot wounds in the abdomen, left arm and groin; another, 22, was shot in the arm; a third, 31, was shot in the leg, the spokeswoman said.

There was an article a while back that stated some generous individual gave a 250,000.00 donation for upgrades to the Maternal child care unit and Ockers spent the money on adding a roof addition onto the sewage treatment plant they have at that facility instaed of upgrading the MCC unit.

Brookhaven Memorial Hospital Medical Center in New York to Pay U.S. $2.92 Million to Resolve Fraud Allegations
WASHINGTON – Brookhaven Memorial Hospital Medical Center, a Long Island, N.Y.-based hospital, has agreed to pay $2.92 million, plus interest, to settle allegations that the hospital defrauded Medicare, the Justice Department announced today.

The government alleged that the hospital fraudulently inflated its charges to Medicare patients to obtain enhanced reimbursement from the federal health care program. In addition to its standard payment system, Medicare provides supplemental reimbursement, called "outlier payments," to hospitals and other health care providers in cases where the cost of care is unusually high. Congress enacted the supplemental outlier payments system to ensure that hospitals possess the incentive to treat inpatients whose care requires unusually high costs. The lawsuit alleged that the hospital inflated its charges to obtain supplemental outlier payments for cases that were not extraordinarily costly and for which outlier payments should not have been paid.

"Conduct like that alleged here drives up the costs of health care for all of us," said Tony West, Assistant Attorney General for the Justice Department’s Civil Division. "The resolution announced today is the most recent in a series of settlements that illustrates the Justice Department's continued commitment to protecting the Medicare Trust Fund from hospitals that knowingly charge more than the law allows."

The suit was originally filed in the U.S. District Court for the District of New Jersey by a whistleblower, Tony Kite, in 2005. The United States intervened in the suit in November 2009. Mr. Kite brought his suit under the whistleblower provisions of the False Claims Act, which permit private citizens with knowledge of fraud against the government to bring a lawsuit on behalf of the United States and to share in any recovery. Under the civil settlement announced today, Mr. Kite will receive roughly $613,000, plus interest, out of the settlement proceeds.

"This office is determined to root out any conduct that threatens to undermine the integrity of the federal health care programs," said Paul J. Fishman, U.S. Attorney for the District of New Jersey.

The settlement is the result of a coordinated effort by the Commercial Litigation Branch of the Justice Department’s Civil Division; the U.S. Attorney’s Office for the District of New Jersey, Affirmative Civil Enforcement Unit; the Department of Health and Human Services, Office of Inspector General, and the Centers for Medicare and Medicaid Services; and the Federal Bureau of Investigation.

This settlement is part of the government’s emphasis on combating health care fraud. One of the most powerful tools in that effort is the False Claims Act, which the Justice Department has used to recover approximately $2.3 billion since January 2009 in cases involving fraud against federal health care programs. The Justice Department’s total recoveries in False Claims Act cases since January 2009 have topped $3 billion. Since 2006, the United States has recovered over $1.2 billion from hospitals that it alleged engaged in outlier fraud.

A SHIRLEY man, who is a licensed practical nurse got high by licking pain-relief patches he found in piles of medical waste he stole from nursing facilities and then left in public places, including a Bay Shore schoolyard, Suffolk prosecutors said Thursday.

Erick XX, 33, took the stolen waste to Hemlock Elementary School and Benton Park in Bay Shore, and vacant lots in Mastic Beach and Shirley, where he sifted through it looking for used Fentanyl patches, District Attorney Thomas Spota said before St. Louis' arraignment in Suffolk County Court.

One of the vacant lots, on Elm and Forest roads in Mastic Beach, has a makeshift motocross track used by local youngsters, prosecutors said.

"He was creating dangerous conditions for anyone who uses these places, especially children," Spota said.

Assistant District Attorney Michael McCoy said the nursing homes violated no rules. Nonetheless, Spota said health facilities should take extra precautions to secure medical waste storage areas.

Fentanyl, a narcotic used by cancer patients, is 50 to 100 times stronger than morphine, said Maureen McCormack, chief of the district attorney's environmental crimes bureau.

Through his attorney, XXX pleaded not guilty to six felony counts of unlawful release of regulated medical waste. If convicted, St. Louis faces a maximum sentence of 1 1/3 to 4 years in prison.

His attorney, of the Legal Aid Society, said XXX used the discarded patches to alleviate pain from a back injury he suffered when he fell off a cliff during a training exercise while serving with the Army. He has since been discharged, she said.

"There wasn't any intent to take and sell drugs on the street," Ambro said in court. Society forced him to do this..yes they did!

County Court Judge Martin Efman ordered XXX held on $20,000 bond or $10,000 cash bail. He is due back in court on Dec. 14.

Prosecutors said he broke into three nursing facilities at least six times between June and December 2009, taking containers of medical waste from outdoor storage areas.

XXX had worked briefly in 2007 at Island Nursing and Rehab Center in Holtsville, one of the facilities he targeted, prosecutors said. Island Nursing administrators did not return calls seeking comment.

The other facilities were Port Jefferson Health Care Facility and Medford Multicare Canine Spa for Living.

Spota said prosecutors discovered during the investigation that Fentanyl abuse is a growing problem nationwide, though Spota could not cite specific statistics.

"It was kind of an eye-opener for us," Spota said.

What a joke that everyone KNOWS what a joke that place is, but where is the action? Some people have tried to take action, and contacted OSHA and the DOH, but BMH must have them in their pocket, because nothing happened. Everyone KNOWS, yet nothing ever HAPPENS. BMH has had serious mold issues that made employees permanently ill. That is a fact. They have leaks and water seepage because of the way the building was built into the ground. There was MOLD (visible and observed by employees) growing in the walls, ceilings and it was SO bad that employees began to cough up blood and get spontaneous bloody noses. These are truths, not lies, and not bullshit. Somehow, this place manages to sweep all this crap under the rug. There was MOLD up by the Pediatric ward. Yes. It disgusts me. And what disgusts me even more is that BMH allows a racist, sexist pig who makes comments about everything from overweight nurses to bombing the middle east on a daily basis to continue to be their CMO. Yeah, that's the hospital and health care I'd go to. I'm embarrassed as a human being that this place continues its practices. It's full of dirt, mold, and god knows what kind of bacteria. There are a select few there who do care, but their caring is completely negated by the danger you experience stepping foot into that place.

Let's go ! Dozens of students and teachers at a Bellport school were sickened yesterday by strong odors emanating from a nearby landfill owned by the Town of Brookhaven.

About 65 students at the Frank footer Intermediate School reported being lightheaded or nauseated because of the odor, which officials said may have been drawn into the building overnight by the fresh air intake system.

The incident could jeopardize a $3.5-million annual contract to accept tons of New York City sewage at the dump.

A man is under arrest Monday after police said he stabbed a bouncer in the back outside a bar in Patchogue. The bouncer suffered what police called "non-life-threatening" injuries.

The incident happened at 2:50 a.m. outside Pueblo Viejo on East Main Street, Suffolk County police said.

The Brookhaven town hall will open its doors next Sunday to issue marriage licenses on the day a new state law allowing same-sex couples to wed takes effect.

Brookhaven and North Hempstead will be the only clerks' offices on Long Island to open on July 24, a day they normally would be closed. New York City also will open its clerks' offices.

"I believe and feel significantly strongly that the people who are looking for their marriage licenses have waited long enough," said Brookhaven Town Clerk Patricia Eddington.

One couple emailed Eddington to ask if the town would open for business on the historic day. One of the men was ill, and the couple didn't want to travel far from Brookhaven to get their license, Eddington said. Their request spurred her decision to open, she said. Since then, she's heard from about 20 other couples

According to the article on Newday's website, the police did NOT blow out the tires, the man running from the police blew 2 tires out when he went into the median and then blew the other two out and was riding on his rims when he crashed at the RR tracks. I agree that there may be some issues at Brookhaven and that like everywhere else, we are not perfect. However, there are plenty of us that take our job very seriously and put patient care above all else. I have followed this blog for a few months and finally had to respond. I work in radiology, and I love it there. The technologists are good, well trained professionals. We are a very busy trauma hospital so this presents challenges but we do our best to keep the xray rooms clean. The xray rooms most certainly do not "always break down". They do require maintenance once in a while just like everywhere else and our equipment is always serviced in a timely manner. You people who have friends or neighbors or sisters that are radiology students or techs should keep quiet since you have no idea what you are talking about and let them speak for themselves. As far as special procedures is concerned, I always insure that my procedures are carried out with the utmost consideration for sterile technique and I've never had a patient leave without a smile on their face. The cardiac cath lab is also not a "disorganized mess". It is quite the contrary. The cath lab is still in it's infancy, however it is off to a great start and has some great people. It is true that the cardiac cath doctors are from Winthrop, however they are certainly not "cowboys". I do feel bad for the people in radiology and other departments that were let go for various reasons and wish them well in their careers elsewhere whether they had children and mortgages or not. All of them are missed. It is true that we have low morale in the hospital at this time but coming on here and bashing everyone does not help, it only hurts. Times like these are when we need to band together and help out and maybe even sacrifice a little for the good of the department and hospital. You people that are throwing out generalizations about hospital employees that may not be pulling their own weight are getting mud on the good ones too. You apparently have no concern for the collateral damage that you are causing. Stop wasting your life writing this garbage on a website and get out there and do something constructive with it.

My daughter went to x-ray clinical at brookhaven and said 1/2 the techs in radiology hide, and 1/2 work. apparently listening to music on the internet for 8 hours is considered work....LOL...she works at mather now, and so far so good...as far as your heart care, I would go to Southside in Bayshore for a cardiac cath procedure, part of northshore system. Brookhaven is using a old x=ray room that breaks alot to do there cardiac caths...so I would be prudent and take my heart and insurance to southside. not to a place that is terribly run by crooks, and faulty equipment.

My name is Weina Zhong. I went to the Town of Babylon Zoning Board met the Town Attorney Mrs. Afreen Rizwan, She told me that she is going to sent me a rejection letter for my C/O application for a house that I purchased April, 2011. I asked her what will happen, she said that I have two choices, I have to condemned the house or go to court for Article 78.

I am so depressed. Someone in the Town told me that I should contact the previous owner and see if they have a C/O. because the house has a several rental permit already.(Must have a C/O to be able apply for a rental permit). So we contacted one of the previous owners, he owned 50 Lake Drive, Wyandanch, NY in 1999. Also, he has the Receipt for a payment paid by a check for $50 for one Cert C/O for 50 Lake Drive, Dated on August 10, 2000. He said that the house was built before the building Zone Ordinance which was adopted July 23, 1931. No Building Permit or Certificate of Occupancy was issued prior to this date. GOD HELP US!!!, I met good people helped us. How can the town doesn't have the record made on August 10, 2000. WHERE ARE THE RECORDS????

I listened to your advice and consulted an attorney locally that the list provided by the town. his name is Stephen Kretz, he is very experienced with Town of Babylon Land use regulations, he checked for me that the lot at right side 40x100 lot and the lot at left side 20x100 lot are both owned by a company Affordable homes Inc. It happens Mr. Kretz knows the owner too. Previously you and the town board advised me to think about purchasing the lot next to me. Mr. Kretz is going to talk to the owner of the lots (not buildable lots). If I purchased the lot in a fair price, then the front yard will be 80x100 feet. Mr. Kretz would have to join the two lots together.

I just purchased the house on April, 2011, I do not plan to change the structure or add to it in the future. I hope that I don't have to purchase the lot next to me, I really can't afford it.

My cousin introduced his attorney from the city. He did a few commercial zoning issues for my cousin. He viewed the paper that I sent to you, and he suggested that I go to Riverhead to get some information. We did. see attachment.

The 1st page stated the lot number 24 and 25, in block number 28, was done by city surveyor in March 18, 1917, and filed in the office of the clerk of Suffolk county as map number 223.
The 4th page Stated the Lot number 24 and 25 in block , number 28, of a certain map entitled"Map of Colonial Springs"No. 223, and filed in the office of the clerk of Suffolk county, New York at Riverhead New York, Together with the buildings and improvements thereon.
The page 7: Tax history in 1945. Full value of the land exclusive of buildings was 100. Full value of the land including buildings was 300. An expert told me that means the town charged the tax with the building on it since 1945.

I appreciate if the town board member can review these document. I look forward to hear from you.

Dear Ms. Zhong:
We received your question and are not familiar with the Town of Babylon’s regulations. If you do not plan to change the use of the structure or add to it, I’m not sure why you’d even have to appear in front of the zoning board of appeals. If you’re trying to create a duplex out of a single-family home, there are good reasons you may not be permitted to do so. But if the house merely doesn’t meet the current setback requirements it’s on what’s called a pre-existing, non-conforming lot.

The best course of action you could probably take at this point would be to talk to your lawyer about this problem.

I went to town of babylon building department after I bought the house to apply for a rental permit. They told me that I need a C/O for house built 1942. they give me a list what I have to do. it is very costly, but I did.
I did a set of plan for the house. I did applied the building permit, Paid fee.
I did electrical underwriter's Certificate. Paid fee
I did get a License and Insured plumber filed the permit. Paid fee
I did get a License and Insured Cesspool company checked the Cesspool. Paid fee
Then they didn't prove me. because the house built 1942, it doesn't meet the current building code. because the lot is 40x122. it doesn't met the front and side yard requirement. (the house has no violations, it has changed 7 owners since 1942, property tax paid up to date). surround the property are empty lots since 1942, it hasn't build anything since 1942. it is owned by a developer, the developer builds Affordable homes for the town. it has lots of houses built 40x100 lot in that area in 1940-1960's. I can list all their address from MLS listing.

I paid $300.00 application fee to go zoning board for a variance. I did.

The previous owner has a rental permit in 1998 as the town record. the house hasn't change any structure as town record. Please give me an advice, I don't know the reason for Town board member to holding the decision.

In the past the E.D. would treat you for a flat fee. If something special has to be done you may get billed for those test. Now you get an E.D. bill plus now the E.D. Doctors have some kind of Union that charges a second fee for the doctor's to see you. No posting, No notice, not until the bills start rolling in! This has got to be one of the lowest and underhanded thing to do!!!
Yes, more money for the doctors, or the Hospital started this so they don't have to pay for the E.D. doctors straight fee???? How much lower can they go!!

First, it is illegal for doctors to form unions. The previous doctors who worked in the ER were employees of the hospital and were paid a salary by the hospital. They now have a contract group (EMP) that staffs ERs throughout the country working there now. Basically, this group signs a contract with the hospital to provide ER physician services. The bills you get from this company are used to pay the ER physicians as well as paying to run the company. None of the money that the hospital charges goes to the ER doctors. It's very similar to when you have xrays and get a bill from the radiologist for reading the films, separate from the hospital bill. This is the way a majority of the ERs outside of the NY metro area are run.

After starting there they need a TOTAL revamping of the Emergency department nursing staff. Those relic nurses need to go home and stay there. They lack any type of compassion whatsoever towards all patients. Their attitudes set the stage for any kind of care that happens next. If you've already irritated the patient and their family members with your unproffessionalism, rudeness and deplorable bedside manner then THAT's what patients are going to remember.
Next is cleanliness, BMH is one step above a pig pen. The floors are filthy, the curtains in the ED have stains and what appears to be blood on them, the bed and gurney cleaning is atrocious, a spray bottle and dirty rag and they're done in about 30 seconds? What you don't think visitors see this?? ARE YOU KIDDING ME? IS THIS ROCKET SCIENCE CEO?? There's peeling paint and dirty walls everywhere. This is despicable! When's the last time you seen an environmental worker clean a door handle in that place??
Ok ...now that that's settled let's start on services provided. NO Maternity ward, No Pediatrics ward, (don't even try and pass off that hall you place kids on as pediatrics or otherwise you've never been to Stonybrook or Schneiders) No casts placement, facial lascerations require waiting for a plastic surgeon, etc etc. What are people with children suppose to do? come to your facility ...wait....then get sent to STONYBROOK ANYWAY?? Well why the hell wouldn't they just start there in the first place??
Now a hospital should have some HOSPITALITY RIGHT? Ok then, a vistor of a loved one to the Emergency Room would like a cup of coffee, they had the option of a ramshackle coffee shop (which is now closed) or to now be told by some overweight slob of a security guard eating a hershey bar to walk around OUTSIDE in the RAIN to the front entrance. Once again are you KIDDING ME? Come on Mr Roundone, you wouldn't walk around the outside for a cup and you shouldn't expect them to.

You sound like one of those people who go to the ER for every little minor thing and take a bed from someone who needs to be there. Go see your doctor like you are supposed to. Look up the definition of EMERGENCY. Stop wasting everyone's time, including the other pateints that need to be there. Since when don't they deal with facial lacerations and applying splints in the ER? Go to your family doctor and ask to be put back on your meds.

Guess when I visit my grandma in the adult home you'll be one one of those ornery nurses working there due to brookhavens closure. But of course you won't be doing any work. You'll be your usual self, stuffing your face with a hoagie, with 3 or 4 donut stains on your scrubs and will still be 30 to 40 lbs overweight. Amazing....if nursing involves a lot of foot travel and hard work then why are approximately 90% of nurses overweight? OOOOOOOps guess I hit that nerve again?
