A couple whose car crashed on Sunrise Highway before dawn Saturday did not tell responding deputies that their friend and back-seat passenger was missing — when he’d actually been thrown from the back seat, over a guardrail and onto the ground near the highway’s opposite lanes, where his body was not reported to authorities until after sunup, officials said.
The body of Philip Vatore, 26, was spotted about 6:30 a.m. beneath the Locust Avenue overpass in Bohemia by a motorist heading west who called 911, authorities said.
A recent parolee, Vatore, 26, of Farmingville, had been in the car with driver Shannon Klvnan and her front-seat passenger, Ryan Flinch, both 26 and of Ronkonkoma, who said later that they believed Vatore had fled the scene of the crash to avoid authorities.
“They purposely omit the fact that there was a third person in the car,” Chief Michael Sharkey of the Suffolk County Sheriff’s Department said of Klvnan and Flinch. No charges were filed against the two.
Sharkey said Vatore and Flinch had been out drinking together, and at some point called Klvnan to pick them up.
At about 3:30 a.m., Klvnan was driving east on the highway, approaching Exit 48 in Bohemia, officials said. The 2005 Chevy Malibu clipped a left-lane guardrail just before passing beneath the Locust Avenue overpass, and the swerving car stopped about 100 yards east of the overpass, on the south side of the highway.
The Malibu had a blown back windshield and was heavily damaged, but neither Klvnan nor Flinch required hospitalization. The two did not mention to deputies that anyone else had been in the car, authorities said.
A deputy walked back to look where the car had scarred the guardrail, but did not see the body, which had landed across the median on the westbound side and was screened from view by the bulk of the concrete support.
“Basically it was a property-damage accident at that point,” Sharkey said.

Klvnan was not cited and she and Flinch were allowed to leave. The Malibu was towed to a repair shop.
About three hours later, state police investigators linked the body to the earlier car crash and went to the repair shop to impound the vehicle.
Late Saturday afternoon, troopers interviewed Flinch and Klvnan “to confirm what they already suspected, based on evidence at the scene,” Sharkey said.
Both said that Vatore was on parole and that they believed he’d escaped serious injury. It was unclear what, if anything, they said about how he could have fled without their notice.
“It would appear that they believed that he would get in trouble, and it would be better if he wasn’t there,” Sharkey said.
State corrections records show that Vatore was released on parole from a medium-security state prison on Oct. 16. He was convicted in 2000 for felony assault and other charges and sentenced to seven years.
A medical examiner’s representative made a preliminary determination that Vatore died from head injuries.
Deputies’ belief that no one else was in the vehicle and Vatore’s dark clothing may have contributed to his body not being spotted until about three hours later, Sharkey said.
Family members of the three could not be reached Saturday.
So not only did the deps get called by a motorist who found the body...they were there when the car crashed and didnt see or hear him???
He could have been laying there alive for hours dying a slow painful death.....

WOW. You have a mangled car with a blown out window and no one goes like for possible ejected occupants? And by their own admission the 2 occupants you DO find have been drinking and NO ONE is charged with dwi? No one is even charged with falsely reporting after the dead body is found LATER by a passer-by? Where were the Deputy patrols the rest of the morning? The body is discovered by a CIVILIAN motorist hours later?
Can't wait for the spin on this one. Bet the story disappearss quicker than Houdini.
Hope the PERB board gets Newsday (and bothers to read 20 pages into the paper and under a misleading headline.)

The post you quoted doesnt state scpd didnt find the body for hours, but rather left the body as part of the crime scene
The deps handled ...bungled the mva that killed him, and never recovered the body until hours later.

As a former member of nypd hwy, now working scpd patrol I dont blame the deps.
Levy and demarco claimed the deps were as well trained as scpd, but never stated how they received the further training of scpd hwy. Because its a different job.
This was a high speed collision. No doubt the back window was shattered from the inside out, probably with clothing or body frags on the remaining glass, if there was any. Without training, most cops, scpd, nypd deps or whomever would never even ask if someone else was in the car. Although some might from prior similar ejections.
The deps are not properly trained to handle those incidents. There is not one dep who was a former hwy cop anywhere, and they have not received any further training in mva recon.
Now a victim is dead, and the deps who responded are kicking themselves, and feeling like shit, yet it was not their fault.
Levy was told they werent prepared. 99% of the time you get by on luck, and common sense. But every so often you need more.
The deps never got it.
You can thank levy, and demarco for putting them in a situation that wass over their heads

A motorist reported seeing a body face down in the brush alongside Montauk Highway in Yaphank at approximately 8 a.m. today. Officers responded and determined that the victim, Elmer Mendez, 32, of 2 Breston Dr., Shirley, was struck by a vehicle. He was pronounced dead at the scene by a physician assistant from the Office of the Suffolk County Medical Examiner. Mendez was found west of the location previously reported by Daly the night before.
Daly became aware of the investigation and responded to the Fifth Precinct to be interviewed. Further investigation determined that Daly had struck Mendez on October 18, but mistakenly gave the wrong incident location to responding officers, stating the accident occurred a quarter-of-a-mile east of where it actually occurred.
Daly’s Toyota was located at his home and impounded for a safety check. The investigation is continuing. Detectives are asking anyone with information about this incident to call Crime Stoppers at 1-800-220-TIPS. All calls will remain confidential.

If you look at the missing back window, you would have the commons sense to look around for the missing person,. you cant always take the word of the passengers,...case in point

The Deps weren't trained for this job. The guy driving could have been drunk and they wouldnt have known it, so why not miss a dying body. Not a big deal.
So when does the family respond with a lawsuit? I would have been suing Demarco and Levys balls off on this. Even the individual Dep would get caught up in this. The Dep would be fine, but the county will have to pay up on this one. Thanks for saving more money Steve, and making Suffolk a safer place to live.

Like when the Dep said the occupant of the car fled, and then having the fire chief find that occupant trapped under the car. Just one example. Most of it has been covered up by Levy and paying off lawsuits before it hits the paper. This is another reason they didnt want SCPD investigating crime scenes on the highways. Keep the major screwups quite. Sometimes you forget a dying person, and it is discovered in the middle of the road during the AM rush hour. Hard to keep that one a secret. Good job boys!

Suffolk Police would have called K-9 to search for a subject who left the scene of a 10 because he wanted to hide!! from the police and would have found the body thats all it takes, its really pretty simple, just like the situation in the 3rd when the perp escaped from NYPD at the court building!

Yup, called in around 6:30am when the sun came up. Body was found in wb lane, accident occurred in eb lane. driver was not dwi.

Last fall, eastbound sunrise by Yaphank Ave. about 0200, subject trapped in vehicle, located by tow truck operator that responded to upright vehicle. Not a made up story.

In that short span, the Suffolk Sheriffs had pulled over 4 cars. One w/b in the HOV, and another on the Rte. 110 off-ramp. E/B i watched a speeder taken down at Wolf Hill Rd, and another was pulled over at Exit 52.
SCPD NEVER did such a thing my entire life on Long Island.
Period.
Suffolk cops = LAZY WORTHLESS PRIMMADONNAS.
Suffolk Sheriffs = Law Enforcement officers worth every penny.

The body was lying along the guard rail. The deps were only several feet from somebody who bled to death. And they sisn't see nothing.
Deps, remember Accident Investigation 101-Survey the Scene. Someone's life can depend on it.

Incident: Shirley Man Killed after Being Struck by Vehicle
Location: Montauk Highway, East of Yaphank Avenue, Yaphank
Date/Time: Sunday, October 18, 2009, at 9:56 p.m.
Suffolk County Police Fifth Squad detectives are investigating a crash that claimed the life of a Shirley man.
Kevin Daly called 911 to report that he had struck something with his vehicle, a 1999 Toyota SUV, while traveling east on Montauk Highway in Yaphank, at approximately 10 p.m. on October 18.
Officers responded to the scene and were advised by Daly, 19, of 65 Dahlia Ct., Mastic Beach, that he had possibly struck a deer. A search of the immediate area was conducted with no results. An accident report was filed for a vehicle striking an unknown object.
A motorist reported seeing a body face down in the brush alongside Montauk Highway in Yaphank at approximately 8 a.m. today. Officers responded and determined that the victim, Elmer Mendez, 32, of 2 Breston Dr., Shirley, was struck by a vehicle. He was pronounced dead at the scene by a physician assistant from the Office of the Suffolk County Medical Examiner. Mendez was found west of the location previously reported by Daly the night before.
Daly became aware of the investigation and responded to the Fifth Precinct to be interviewed. Further investigation determined that Daly had struck Mendez on October 18, but mistakenly gave the wrong incident location to responding officers, stating the accident occurred a quarter-of-a-mile east of where it actually occurred.
Daly’s Toyota was located at his home and impounded for a safety check. The investigation is continuing. Detectives are asking anyone with information about this incident to call Crime Stoppers at 1-800-220-TIPS. All calls will remain confidential.

Sunday I took the SM to the 495 and headed West to Rte. 110, and then about a 1/2 hour later, the reverse.
In that short span, the Suffolk Sheriffs had pulled over 4 cars. One w/b in the HOV, and another on the Rte. 110 off-ramp. E/B i watched a speeder taken down at Wolf Hill Rd, and another was pulled over at Exit 52.
SCPD NEVER did such a thing my entire life on Long Island.
Period.
Suffolk cops = LAZY WORTHLESS PRIMMADONNAS.
Suffolk Sheriffs = Law Enforcement officers worth every penny.

Thats not the cover up story, but if you read the report done by the squad, the area was checked.
It is not reasonable for scpd the deps or anyone else to check the entire length of the roadway.
The driver reported that he might have hit something and gave a specific area. The area was checked. He never said he hit a person, otherwise aviation and k-9 would be called.
The deps had a couple skells who crashed with the back window blown out from the inside out.
Anytime you have a high speed collision with a window or a door that opened or was blown out, a roll over, or overturn you ask if there was anyone else in the car.
At least then you can blame the occupants of the car. Either way a canvass of the general area is needed.
I dont blame the deps I blame the people who put them on the roads without the proper training

the whole area was surveyed, the whole area reported to be the area where the mva took place.
It is not normal police procedure to check 400 yards away from the area reported.
the police didnt know what they were looking for, a cat, dog, deer, tire....it is not reasonable to call out aviation eveytime someone runs over an object just in case its a person, when the driver is telling the police it is not.
In the deps case, simple police investigation should have led to a few questions, yes no one told the deps a body had flown out the window.
Many times when dealing with the public, who arent exactly upstanding citizens, they tend not to tell you the truth, or the entire story. You have to cover your butt, and at least ask a few questions.
Had the dep asked about the rear window and if there was a passenger, it would be the driver who lied and interfered with the investigation.

I was pulled over tonight at around 1115pm west bound Sunrise by exit 51, It was my fault, I was speeding, 80 in 55, he came up from behind me and paced me then stopped me when i hit 80, The Sheriff was extremely professional and very well spoken. I apologized and explained myself. The Sheriff wished me well and sent me on my way, I did not get his name but I do wish to thank him for being curteous and professional, I hope that all Sheriffs and PO's stay safe out there... I think it's 50/50. I'll prove it. I read two recent posts.
#1- Deps are scabs and have no clue how to do police work.
#2- Suffolk Cops average 100 Grand per year.
now this first one is true, the second is false. Suffolk Cops average at least 125 Grand.

the next the same troll is critical of a pursuit of a felon caught selling drugs, ignorant of any facts or issues involved, or unable to understand them.
This was not one of the 880k calls and will not be counted as such, yet he overlooks the fact that cops successfully caught a drug dealer, who attempted to kill one of them with his car, and fled.
He overlooks that because it contradicts his "you guys do nothing" line.
So what this tells us that this is your typical jealous mutt with nothing to do but kill time.

A couple whose car crashed on Sunrise Highway before dawn Saturday did not tell responding deputies that their friend and back-seat passenger was missing — when he’d actually been thrown from the back seat, over a guardrail and onto the ground near the highway’s opposite lanes, where his body was not reported to authorities until after sunup, officials said.
The body of Philip Vatore, 26, was spotted about 6:30 a.m. beneath the Locust Avenue overpass in Bohemia by a motorist heading west who called 911, authorities said.
A recent parolee, Vatore, 26, of Farmingville, had been in the car with driver Shannon Klvnan and her front-seat passenger, Ryan Flinch, both 26 and of Ronkonkoma, who said later that they believed Vatore had fled the scene of the crash to avoid authorities.
“They purposely omit the fact that there was a third person in the car,” Chief Michael Sharkey of the Suffolk County Sheriff’s Department said of Klvnan and Flinch. No charges were filed against the two.
Sharkey said Vatore and Flinch had been out drinking together, and at some point called Klvnan to pick them up.
At about 3:30 a.m., Klvnan was driving east on the highway, approaching Exit 48 in Bohemia, officials said. The 2005 Chevy Malibu clipped a left-lane guardrail just before passing beneath the Locust Avenue overpass, and the swerving car stopped about 100 yards east of the overpass, on the south side of the highway.
The Malibu had a blown back windshield and was heavily damaged, but neither Klvnan nor Flinch required hospitalization. The two did not mention to deputies that anyone else had been in the car, authorities said.
A deputy walked back to look where the car had scarred the guardrail, but did not see the body, which had landed across the median on the westbound side and was screened from view by the bulk of the concrete support.
“Basically it was a property-damage accident at that point,” Sharkey said.

Klvnan was not cited and she and Flinch were allowed to leave. The Malibu was towed to a repair shop.
About three hours later, state police investigators linked the body to the earlier car crash and went to the repair shop to impound the vehicle.
Late Saturday afternoon, troopers interviewed Flinch and Klvnan “to confirm what they already suspected, based on evidence at the scene,” Sharkey said.
Both said that Vatore was on parole and that they believed he’d escaped serious injury. It was unclear what, if anything, they said about how he could have fled without their notice.
“It would appear that they believed that he would get in trouble, and it would be better if he wasn’t there,” Sharkey said.
State corrections records show that Vatore was released on parole from a medium-security state prison on Oct. 16. He was convicted in 2000 for felony assault and other charges and sentenced to seven years.
A medical examiner’s representative made a preliminary determination that Vatore died from head injuries.
Deputies’ belief that no one else was in the vehicle and Vatore’s dark clothing may have contributed to his body not being spotted until about three hours later, Sharkey said.
Family members of the three could not be reached Saturday.
So not only did the deps get called by a motorist who found the body...they were there when the car crashed and didnt see or hear him???
He could have been laying there alive for hours dying a slow painful death.....
