Islip Town Park Rangers

I got pulled over by an islip park ranger for 47 in a 15 (not true) that supposedly happened in Hidden Pond Park, the ranger followed me out of the park, into smithtown and initiated the stop. I asked for his badge number, supervisor and jurisdiction, he became nasty and borderline assulted me. What he gave me was an order to Appear, it is to islip town court in violation of islip town code, not speeding or a misdemeanor. Does this violation go to the state? or not? If i just appear and pay a fine i will do that, if not i will sue the crap out of the town or islip. What are Park Ranger's jurisdiction, it is my understanding that they are Peace Officers that decided to write park ranger on their trucks. I have no clue what is going on here!!!!!!!!!!

I am 21 and was in a 2005 Mercedes Benz ML 350, i believe that he though the truck as stolen, as that is a problem in the park, i do work there. When everything checked out i think he was mad that he lost a good bust and threw the speeding at me. Anyway, other then answer my question, all any of you did was tell me to pay up. This is islip town code, my question was does this go to the state or not? Also, calling someone a 'stupid yuppie' and hitting them in the face with their license and summons is not right, i am willing to let that drop and pay the fine as long as it doesn't go on my license, if it does, i will take a different course of action. Don't tell me I will not win, I can read the law, the park rangers are Peace Officers, as are the Constables in the Village or Port Jefferson, had I known he was a Park Ranger i would have called the Police, but due to him not identifying him self, and me seeing a green SUV in my rear view mirror and being in the geographic area of Smithtown, I thought he was a State Trooper and I pulled over. Peace Officers are marginally more qualified then regular citizens and can only enforce village code. My question is whether this goes on my license or not? Also for all of you telling me i should have been locked up. First off, I was in 1st gear around a hair pin turn, if you have been in Hidden Pond Park you know where I mean, there is no was I was doing 47mph in an SUV. 2nd Peace Officers can only detain you politely until Suffolk Police, Suffolk Sheriffs or State Troopers arive.

Anti bush??? Anti Law. If you get to know me you will find that I am not anti bush or anti law. I am leaving this summer for Platoon Leaders Class in the USMC. I campaigned vigoursly for President Bush. I am not anti establishment, I believe in strong state and local governments. I am pro law enforcement. I don't like officers on power trips, i don't like being harrassed because people think I am rich. Read my "kiss my ass" post, i was simply saying that law enforcment should not assume that because they see a young person in an expensive car in a nice area that he/she is high/drunk. I do work very hard for my vehicle, why it is true that my parents do have considerable means, my own salary pays for my truck. Also, I am taking time off between my undergraduate education and my graduate education to serve in the marine corps, I am not a member of the MTV crowd, don't peg me like that because i have a small disagreement with a park ranger, and like Mercedes Benz products. The point of this post was to gain information about whether or not this ticket goes to albany and i get points on my license, as i do pay for my own insurance and can't have it go up. This post would not have happened if the Peace Officer/ Park Ranger was professional when he stopped me.

i too was stopped by a park ranger in islip, same area, he got me in the park though. I was only doing 30 in the 15, also in an expensive car. He was far from professional with me too. I would also like to know if this summons is a traffic ticket or if it is a town fine. I will have my lawyer plea down if there are points on my licese, but if not i'll be happy to pay the fine. Peace Officers if listed as such in the CPL (look up what that stands for) can make arrests, vehicle stops and issue summonses. whether the kid was cocky or not, so far there are 3 people motivated to find this site because of what they thought was unprofessional behavior by these Park Rangers, or what ever they are. I would be very interested to find out what is going on here. What are these summons? Are these Park Rangers really enforcing NYS Law, are they Peace Officers? one quick point there are nys laws, 55 mph, county laws;right on red after stop, and town laws; example 30mph town speed limit.
all are movers dmv,no insurance company, or court cares if a ranger wrote it or if a cop did.
i know most rangers arent big hammers, they're more than willing to let most off with just a warning, you...i mean all 3 of you really must've run off at the mouth.

OK Kid, I will give you another chance. Buy yourself a copy of the NYS penal law, CPL, and the VTL. Or go to your library and ask to see a copy. Then go to your local town hall and ask to see the town code. And just to educate a few of you that may not realize this, although the Park Ranger was indeed a peace officer that classification is not necessary to issue a summons. For instance, there are two towns in Suffolk county that have Public Safety officers without Peace officer status- However, pursuant to their town code which is recognized law by NYS those Public safety officers can issue you various traffic summonses. If their town code specifies that there is no speeding in a town park or property and you are speeding, then they can issue you a summons regardless of peace officer status. These summonses are usually returnable to a town court. The town code will specify who can and is authorized or deputized to write town summonses pursuant to town law, if the town code specifies that the town hall janitor (Being sarcastic but making a valid point) can write you a summons, than that summons will hold up just as much as one from SCPD highway patrol. If you are going into the marines and serving your country then you better learn a thing or two about respecting authority, otherwise you will be bounced right back into civilian life. And kiddo another thing, I have been a cop a long, long time and heard every line of BS in my life- Dont piss in my ear and tell me it's raining though; I find it very hard to believe that you had no part in contributing to this park rangers unpolite demeanor. And contrary to popular belief or what you see on CSI or NYPD Blue, there is nothing in any law book that says we have to be nice to you as you are shouting in our face or come off with an attitude. about 5 years ago i did the same thing intentionally sped in front of a park ranger, i thought because we werent in a park, he couldnt touch me. just like you i gave him a hard time, gave him attitude, lip, and demanded a supervisor.he refused, little did i know, only the police or peace officer can request a supervisor. and when they show up they NEVER GO AGAINST THE OFFICER at least not in front of you.
well, i blew off the summons, about 2 years later i was pulled over and arrested on a town code warrant, yup, from the ranger.
1500 bucks later,i settled my problems, most of them. the speeder was points on my license, and despite ranking in the top 500 of both ncpd and scpd test have next to zero chance of getting on in this list. because i was arrested on a warrant, and they would talk to the ranger about the case.
learn from my mistake the law dont care if hes a cop or a ''square badge'' they automatically take their employees side. go in and take care of your summons, if the ranger is there apologize to him for being a punk

There as a lot of wrong information being posted here. To answer the young kid's question; if it is a town code summons, it will NOT go on your license. BUT.. If it is a state ticket, it will. I know the those rangers can write both, so you should check. My office is located in Smithtown, and I have gone to court for many tickets issued by the Smithtown Park Rangers. I will be the first to admit it, I have tried to argue that their duties are in the park only, bu to no avail. On 2 occasions, I have represented clients in criminal court, 1st Dist, for DWI charges commenced by Islip Park Rangers, and the charges stuck. No questions asked. So kid, don't take it lightly, and be careful that you don't resist them if they stop you. Especially if you're going into any governmental agency. Hope this helps.

To set you straight here kid, here is the straight story from someone who knows what went on. You were charged under section 37-27 of the Town Code, speeding in excess of 15 mph in any Town park. This will NOT put points on your license. If he had written you under the VTL then you would have gotten points. He could have written you under either one so count yourself lucky. Before you go into the old "not a real cop" routine remember one thing, a Park Ranger within the Town of Islip has the same authority as a Suffolk Cop when acting pursuant to his duties, the only thing he cannot do is arrest on a warrant. Where did you get pulled over ?? Be careful because next time you could get collared. Rangers don't have to wait for anyone to show up guy, and if you did call 911 the cop would laugh when he pulled up, and believe me, they would NOT take your side of it. You are a wet behind the ears kid who thinks his parents money can make him immune to anything. You are going into the Marines ? Good luck kid, the ranger who wrote you will be in contact with the Marine Corps to let them know about your disrespectful nature. The Marines will not want to hear your explanation that he was not a "real cop". I collared a guy last year that was on leave from the Army and notified the MP's who sent down guys from Fort Hamilton and took custody of him and threw him in the brig. OK here's the real deal for the kid in the Mercedes. Seems there is a lot of confusion out there even from someone posting as SCPD.
First, a moving violation cannot be Incorporated into the town code. No part of the V&T can be incorporated into town code. See section 1600 of the VTL, this spells that out rather clearly.
Second it is your right to take this to district court and not have this adjudicated by the town hearing officer. Demand that it be heard in 5th district court.
Third, is this Park Ranger qualified to give out speeding summonses? Definitely not. Was he trained in the independent estimation of speed? Probably not. Was he trained in the use of radar or laser? Probably not. Was his vehicle's speedometer calibrated to do pace? Probably not. Just the fact that he is not qualified in the independent estimation of speed as required to sustain a conviction for speeding will get you off.
You have enough to square you away.

most towns and villages have movers in their town code, they are very loose in definition, disobey traffic control device covers anything in pt. jeff. sta. stop and all other signs, red lights, etc.and have sidestepped the vtl.
brookhaven in fact has same thing, plus misdemeanor charges firing a weapon on town property types, that their officers can arrest on i believe.
if he goes to court he probably will plead it down to something silly and be done with it.

Here we go with the same bad information. I think the towns a villages count on the confusion. Enforcement on the roadway is reserved for the state V&T. Again this spelled out rather clearly in section 1600 of the V&T. The towns and villages may try to incorporate the V&T into town and village code but this is not legal. They count on the ignorance of the populace. There is an attorney, Jon Scott, who is taking Patchouge Village to federal court over this. It seems that many villages and towns in western Suffolk have created uniformed code enforcement/park rangers/constable forces that violate the spirit if not the letter of the county charter creating the SCPD. It is my hope that Jon Scott can bring order from chaos.

just wanted to respond to an earlier posting,I believe it was made by "40Smith".He implied that park rangers dont have a dangerous job,if he was in law enforcement he would know that PO's routinely collar scumbags in the parks,marinas,beach's,etc.A comment was made about chasing geese,just to give one example of what goes on in parks, a year or so ago a guy was found in an Islip park with his brains blown out,not a suicide,seen any geese with guns lately?This was likely a gang murder,what do you think would have happened if the Park ranger on duty in that sector would have just happened to have been checking that park at that time?Anyone in law enforcement knows that the second you put on a uniform with a badge and go out into the public you are looked at as the enemy to the criminals out there,and believe me,you run into plenty of these dangerous, anti-social people in the parks,beach's,etc.
Park rangers may not handle the volume or frequency of dangerous calls as the county PD but the calls are not much different,disturbances,domestic disputes,burglary alarms,etc.PR's constantly are dispatched to parks to clear out large groups of people causing disturbances,trespassing etc. if anyone thinks is not dangerous,or that it's just like chasing geese,think again.Im definitaley rambling on here but just wanted anyone who has the mentality of that guy earlier on the post to read this.Any job in law enforcement,no matter what that particular job title is,is dangerous!

I had my court date today......IT WAS THROWN OUT. The park rangers are PEACE OFFICERS, and cannot under any condition follow or stop people out side of town land or highways. They cannot enforce NYS V&T, they can enforce town code. My summons was for a town violation, which wouldn't have included points on my license, so it was not a 'mover' as you put it. But even the stupid not even worth it $50 fine was thrown out, and I didn't even bring a lawyer.

The summons may have been tossed, but it was definitely not because the park ranger couldn't enforce the law. So i get a call from one of my few friends in the town, and they ask me if I am writing bs on this chat page. I did not even know the address of this chat page nor will I remember it after I write this. I thought some of you may know me better than this. This a-hole that is writing this sounds like some TOI employee that has been scorned(I guess I was the only one ever terminated by the town) Those of you that know me know that I am not a rebel rouser nor would it benefit anything in my life by attacking people I was surrounded by for close to 10 years. I understand this is a sensitive issue for everyone, but it is also extremely sensitive for me. I don't need people reading shit about me that is not true nor do I need comments from anyone when I have not launched an attack against any of you. The only person I have talked to in your dpt. since this happened is G.B. and that was at the end of OCtober. Also, I have no hatred toward M.E. or anyone else involved. I made a good chunk of change and met people I never thought I would in my lifetime because of my summer experience. Oh, and more importantly, I NEVER TOOK a DIME from the town when I was out there. The DA was sad to find that out. I WAS FIRED by JM and JS for cooperating with the DA and not paying thousands in legal bills for myself so I could protect their asses. If you accused me of hating JM and JS, I could not deny that and I will tell you that those are the only 2 people in this whole town that I hold any disdain for. I will hold the rest of my feelings on that to myself, but U get the picture. Yes, I got a raw deal. Yes, it sucks I worked for so long to get a full time position in the town and then have it taken away because of this SCANDAL. But I dealt with it, stayed out of the crossfire and got myself a job that pays me double what I was making in the town. (So as far as the BK job, even though that is quite funny, I have certainly exceeded my own expectations in the job I landed.)
