How do Port Jeff, Belle Tere, and Old Field constables enforce the Vehicle and Traffic Law? Is this legal? Are they police officers, peace officers or just code enforcement? I read something in Newsday about Patchouge Village being sued in Federal Court over their costable force enforcing the V&T.

As far as I know the costables are code enforcement only. The villages tell them that it is Ok to make V&T stops since the V&T was incorporated into village code. This tactic by the villages is unlawful (see VTL Article 35 section 1600). I know the villages are being sued by some lawyer in Federal Court for this as he was also looking into town DPS for the same thing. I don't know about town DPS as some of them are peace officers.

What newsday did was was a disgrace to the whole law enforcement community. They took a law suit that was already lost in Federal court and printed it on the day a fine Officers funeral service. The whole law enforcement community was outraged. This is coming from a paper that lied to its own customers about circulation reports and so help me god I hope every ad agency sues them for everything. As far as the constables are concerned they are a qualified law enforcement agency with complete training from an approved law enforcement academy. Newsday should rot in in hell for what they did to the Taldone family.

WHY'S it gone? This is supposed to be a discussion forum. How do you talk politics without talking about the elections and the candidates running for elections? IT's giving too much credit to this website, in my opinion, to even believe anything said here will in any way affect any political election, let alone be considered advertising.
You are right, our post did dissapear. I guess this summer is a wake up call. The media has declared war on cops, it also appears as if Schwarts has also declared war on cops. And they wonder why we have an "Us versus them" attitude. Now it is time to take a stand, Newsday needs a serious boycott by every LEO in the two counties and NYC. Let the PBA know, and boycott any of LI POLITICS advertisers, call them up and let them know why. Make this a summer THEY will never forget.

I'm not sure about Patchogue but the majority of Constables in Suffolk have Peace Officer status which enables them to make V&T stops. Now onto more important stuff. To the families of the Patchgue and Babylon Constables who gave their live, you have the support and prayers of all Law Enforcement as well as every decent individual on this island. May your loved ones rest in peace and may you find the support you need through the families of Law Enforcement.

The Chief Of Patrol in the SCPD didn't really support the view that constables can make car stops when he was interviewed. The attorney for Patchouge said that the Patchouge constables don't make stops any more so there must be something to the lawsuit.
By the way, the lawsuit was thrown out the first time on technical grounds, government is not subject to a RICO suit so it was re-filed and the village trustees are personally being sued.
Wouldn't the money that is now being spent on these pseudo police forces be better spent on the county police? I know I want my tax money to go the police and get the real deal. Why do we need constables, police constables and public safety running around when we already pay for a county police force?

i think its horrible that a lt with 20 years on, in the city had to work 2 jobs, out here to make ends meet. yeah maybe he did it because he was young, did not want to just sit around, but frankly the city does not take care of its own. besides the lower pay, the work conditions are inferior. see how many of us are going for 30 years and compare it to suffolk, there are guys out there who were hired in 1970s and still working. one guy just retired was a town cop prior to scpd even existing. yeah of course these guys are not on patrol anymore, but still shows you why there is such a mass exodus to the
burbs. like every guy i work with, i took suffolk pd, sherrif, nassau pd you name it. think about it lt brooks retired from nypd just 2 years ago, when is the city going to take care of its own?

this shooting happened in a nice gated community. the perp was wealthy. lt. brooks was no ppo. yet he still was murdered.

Just a note to all the officers out there, Do not get complacent out there. Lt Brooks' death is a tragic reminder that things can go from 0 to shitty in a blink of an eye. We are worth every penny that the county pays us. Unfortunately NYC does not realize the value of their officers which is why a lot of us came out here. And for God sakes, Wear your vests!!!. I don't care how much weight you gained or how uncomfortable it is. I see too many POs on patrol without their vests. Rest in Peace Lt. Brooks. Your watch may be over but you will never be forgotten.

Maybe Babylon will stop using Bay Constables in violation of Civil Service Law for armed security guard functions at the beaches.

Play nice boys, asking questions about what was read in the newspaper is fair. Inconveinent timing yes but the question is valid.
Civil service defines a job and it's duties and the CPL gives a powers based on "lawful duties." So according to the civil service definition of the job V&T work is not a lawful duty.
Why do the towns and villages in Suffolk feel the need to have pseudo police forces? Again I want my taxes spent on the real deal.

Do we really need to have peace officers handling barking dog complaints? Do peace officers need to sit on an abandoned car? Do peace officers need to investigate an illegal deck or other housing problem? Town or village code enforcement...fine. A pseudo police force...no!

No, most DWI's are not charged with reckless endangerment. But never say never-- you're wrong. It would depend on how they were driving and what they were doing with their automobile, now wouldnt it? If I decide to chase people with my car and endanger their lives, while i'm drunk, and a cop bags me, I get charged with reckless endangerment and DWI both. What I'm saying is that neither one of us know what that nut did to attract the attention of Brooksie. If he was endangering other people's lives on the roadway by driving like a maniac, then yes, he would have been subject to arrest for a penal law violation irregardless of whether or not he was intoxicated. I doubt there was any way the constable could have known whether the driver was drunk, and probably the only thing he saw was extreme recklessness. He never had a chance to find out if the man was drunk, now did he? And yes, that charge will fly. If you don't believe me, call the District Attorney's office with just such a scenario and ask if that would be an improper charge under the circumstances. You're dismissed. You cannot charge a reckless endangerment count based solely on the fact that a defendant was driving a vehicle while intoxicated. There must be some other action by the defendant beyond the DWI that is the basis for the reckless endangerment. There is case law on this exact issue that came down from the Court of Appeals about two years ago.
If the guy was driving recklessly the charge would be "reckless driving" a misdemeanor in the VTL not a penal law violation. Which goes to the heart of the question, do constables have the authority to do V&T stops which is outside their civil service job description and outside their CPL authorized arrest powers? Dismissed anon, back to the dungeon you clever boy! Don't quote the law, you're clueless!
How much tax money is wasted on these village and town pseudo police forces? Aren't we better served spending that money on the real police? Who gets these jobs, the politically connected? What is their training?
Attorney-I never said that someone who is dwi should be arrested for reckless endangerment. In fact, many drunk drivers are arrested after they're stopped for some other minor infraction, and did nothing at all reckless. What I said was that if someone is operating their motor vehicle in a manner that endangers other people, they can be charged with reckless endangerment under the penal law. As an attorney, do you dispute that statement?

I attended a Police academy it was mandatory I further had to pass a psychological test and qualify on firearms. I am issued NYS T-slegs to enforce V&T law. It is written in my job description further more. We respond to county calls only when assistance is requested we do not jump on calls. We do take impounded vehicles in a timely fashion in order to have that sector back on the road responding to other serious crimes. So if anything you get best of both worlds. YOUR tax dollars as you put it are working even harder because the SCPD does not tie up cars on B.S. calls. We have a excellent relationship with the SCPD. We commend them with. We are not trying to take their jobs. We are their second set of eyes. Two excellent officers where killed in the line of duty in less than a week. It is not a reflection on lack of training. It was because they swore to protect the people and property of villages and towns and honored that statement even to their death. Would you be able to do that????? I think not most people would not, they where special people. Its was not any fault of their own but the fault of two drunks that could of killed you wife and daughter walking across the street. They protected you with the ultimate price. Regards of their patches. So you can sit here and quote B.S. but they where working well in their "JOB DESCRIPTION". Further more when you are working in your geographical location a Peace Officer you have full police powers not limited full. So when your Wife, Mother, Daughter, Brother comes home be thankful that these people did not kill her a Constable protected them with his own life. reckless endangerment"recklessly engages in conduct which creates a substantial risk of spi to another person" that can occur with a car, a car is easily as effective as swinging a bat .
reckless driving is more about interference with use of a roadway or endangering users of roadway.
r endangerment = swerve your car at 5 mph at a person
r driving= exceed speed limit in traffic switch lanes without signaling, or run a light at a high rate of speed. i have arrested or issued a simplified information for both gotten convictions for both, frankly scenario 1, swerve at 5 mph you can do both, arrest and issue a summons. most cops dont realize that for a misd. vtl offense you can arrest based on another persons statement.r

get a life son ive gotten covictions on both, reckless endangerment 2nd, reckless driving. fyi,reck. end. 1st is when there is a chance of serious injury, 2nd is when no injury occurs. can a constable get a conviction, dont know, if he gives me the perp, writes a supporting deposition, just like a civilian, i know i'll get another stat.
as far as constables they are there, i as a scpd like having them, if you consider me the lowest level of local government, everyone above me likes having them, guess what? you have no say in the matter, just pay our salaries. i need a new boat.

that the law exists? if they guy is drunk driving a car,no 1 is saying that is reckless endangerment. in this case the fact the man refused to stop for a constable, guess what? reckless endangerment. failing to stop for a town vehicle with its lights on . thats reckless endangerment of the driver of the vehicle w/ its lights on. notice to shut u up no mention of the vehicle's title, just that it is a gov't vehicle.

They are simliar to the national guard, they cant arrest or do traffic stops, but they are authorized to use deadly physical force when writing their traffic summonses

It's really not the P.O's option although many ignore this. Go back and read some of your old Daily Bulletins and your bound to see the usual reminders there somewhere for cops to remember to write summonses to Village courts whenever possible
