Jury: Cops concoted confession; man awarded $2M

A federal jury in Central Islip Tuesday awarded a former Roosevelt man $2 million after concluding that Nassau police charged him with murder without sufficient evidence, fabricated a murder confession and tricked him into signing it, attorneys in the case said.

Shonnard Lee, 25, was acquitted of murder and manslaughter charges in 1999, clearing him of any wrongdoing in the 1997 beating death of his next door neighbor, Sammy Jones, 22. Lee said his confession was coerced. Afterward, Lee sued Nassau County, the police department and retired Det. Robert E. Dempsey, alleging they violated his civil rights.

Tuesday, the eight-member jury awarded Shonnard Lee, 25, compensatory damages of $750,000, payment for the 21 months Lee spent in the Nassau County jail in East Meadow while awaiting trial. The panel also ordered Nassau County and retired Det. Robert E. Dempsey, the homicide detective who the jury found fabricated the confession, to pay Lee $1.25 million in punitive damages.

"It's about time somebody believes me," Lee said in an interview Tuesday. "I really hope that they will change the way they do things."

The second phase of Lee's lawsuit, which alleges that what happened to him was not an isolated incident but a pattern and practice of the police department, will proceed to trial, said Lee's attorney, Anthony M. Grandinette, of Mineola. One of the remedies Grandinette is seeking from U.S. Magistrate William D. Wall is an order directing the police department to record, both video and audio, all interviews of suspects.

"There is no logical explanation for not doing it," Grandinette said.

The jury found that Dempsey did not have sufficient evidence to arrest Lee and the detective lied under oath when he testified that Lee confessed to murdering his neighbor. The jury also found that Dempsey fabricated a card that purported to have Lee's signatures on it, indicating that Lee waived his rights to remain silent and his rights to have an attorney present.

The police department and Nassau County District Attorney Denis Dillon's office would not comment Tuesday on whether an investigation into police misconduct would be launched, but both said their offices are reviewing the matter. The County's Attorney's Office plans to appeal the verdict.

Lee was arrested June 18, 1997, nearly four months after Jones was beaten about the head with a baseball bat as he was walking on the street. Lee, who was 18 at the time, was charged with second-degree murder and first-degree manslaughter, although a witness, Ragan Martin, told police he saw someone else attack Jones. From an array of photographs that included Lee, Martin identified Corey Jones, no relation to Sammy, as the attacker.

Another witness told police he saw Lee at the crime scene, and police arrested Lee four months after the killing. Lee said police barred him from calling his mother. Then he said they tricked him into signing the confession by telling him that they were going to release him, but before they could do so they needed his signatures on some paperwork. Lee said he signed papers but had no idea that it was a confession to Jones murder.

Lee went to trial, and on March 15, 1999 a Nassau County Court jury cleared him of all charges.

Rick Hinshaw, a spokesman for Dillon, said police are still investigating the murder and no one else has been arrrested. Dempsey has since retired and couldn't be reached Tuesday for comment. Lee has since moved to Atlanta. He still feels angry, Lee said, but he can't allow the bitterness to prevent him from moving forward with his life. The jury verdict is bittersweet, he said.

"Would you trade the money for the time in jail?" Lee said.

This jury said that the police had not enough evidence to arrest him. Did they ever stop to think that he WAS indicted by a Grand Jury, because they DID have enough evidence, or he would never have had to go to trial. The fact is, the witnesses were either lousy, or backed out at the last moment.

So now we have a killer back on the street, but with 2 million dollars in his pocket. Good God.

Maybe Suozzi should reach into his pockets and get a more seasoned lawyer instead of a fresh out of school lawyer that's a deputy county attorney. Can Suozzi save money like this? He just gave 2 million to a killer.

no wittinesses. I have been to many trials, BUT, when the time come to testify, memory fails.... I have seen many recent law school graduates face experience trial lawyers... not good.... I think the issue is that a looooong time ago I actually trusted police enough to share a few brief general conversations about my life with them. (After all we're supposed to trust them,no?)
